Larry May argues that the best way to understand war crimes is as crimes against humanness rather than as violations of justice. He shows that in a deeply pluralistic world, we need to understand the rules of war as the collective responsibility of states that send their citizens into harm's way, as the embodiment of humanity, and as the chief way for soldiers to retain a sense of honour on the battlefield. Throughout, May demonstrates that the principle of humanness (...) is the cornerstone of international humanitarian law, and is itself the basis of the traditional principles of discrimination, necessity, and proportionality. He draws extensively on the older Just War tradition to assess recent cases from the International Tribunal for Yugoslavia as well as examples of atrocities from the archives of the International Committee of the Red Cross. In distinguishing justification from discovery, the logical empiricists hoped to avoid confusing causal matters with normative ones. Exaggerating the virtue of this distinction, however, has disguised from us important features of the concept of a reason as it functions in human practice. Surfacing those features gives some insight into reasoning and argument.

This paper proposes a causal-dispositional account of rule-following as it occurs in reasoning and intentional agency. It defends this view against Kripke’s (1982) objection to dispositional accounts of rule-following, and it proposes a solution to the problem of deviant causal chains. In the first part, I will outline the causal-dispositional approach. In the second part, I will follow Martin and Heil’s (1998) realist response to Kripke’s challenge. I will propose an account that distinguishes between two kinds of rule-conformity and two (...) kinds of rule-following, and I will defend the realist approach against two challenges that have recently been raised by Handfield and Bird (2008). In the third part, I will turn to the problem of deviant causal chains, and I will propose a new solution that is partly based on the realist account of rule-following. (shrink)

There is extensive discussion in current Just War literature about the normative principles which should govern the initiation of war (jus ad bellum) and also the conduct of war (jus in bello), but this is the first book to treat the important and difficult issue of justice after the end of war. Larry May examines the normative principles which should govern post-war practices such as reparations, restitution, reconciliation, retribution, rebuilding, proportionality and the Responsibility to Protect. He discusses the emerging (...) international law literature on transitional justice and the problem of moving from a position of war and possible mass atrocity to a position of peace and reconciliation. He questions the Just War tradition, arguing that contingent pacifism is most in keeping with normative principles after war ends. This article reconsiders Hannah Arendt’s account of “totalitarianism” in light of the climate catastrophe and the apparent inability of our political-economic system to respond to it adequately. In the last two chapters of The Origins of Totalitarianism, Arendt focuses on the “ideology” of totalitarian regimes: a pathological denial of reality, a privileging of the ideological system over empirical evidence, and a simultaneous feeling of total impotence and total omnipotence—an analysis that maps remarkably well onto the climate zeitgeist. Thus, while Arendt (...) used the concept of “totalitarianism” to foreclose alternatives to liberal capitalist democracy, the climate impasse suggests that the totalitarian label more properly belongs to the prevailing system itself. Are our beliefs justified only relatively to a specific culture or society? Is it possible to give reasons for the superiority of our scientific, epistemic methods? Markus Seidel sets out to answer these questions in his critique of epistemic relativism. Focusing on the work of the most prominent, explicitly relativist position in the sociology of scientific knowledge – so-called 'Edinburgh relativism' or the 'Strong Programme' –, he scrutinizes the key arguments for epistemic relativism from a philosophical perspective: underdetermination and (...) norm-circularity. His main negative result is that these arguments fall short of establishing epistemic relativism. -/- Despite arguing for epistemic absolutism, Seidel aims to provide an account of non-relative justification that nevertheless integrates the basic, correct intuition of the epistemic relativist. His main positive result is that the epistemic absolutist can very well accept the idea that people using different standards of justification can be equally justified in holding their beliefs: Rational disagreement, he maintains, is perfectly possible. -/- The book provides a detailed critique of relativism in the sociology of scientific knowledge and beyond. It is well known in contemporary Madhyamaka studies that the seventh century Indian philosopher Candrakīrti rejects the foundationalist Abhidharma epistemology. The question that is still open to debate is: Does Candrakīrti offer any alternative Madhyamaka epistemology? One possible way of addressing this question is to find out what Candrakīrti says about the nature of buddha’s epistemic processes. We know that Candrakīrti has made some puzzling remarks on that score. On the one hand, he claims buddha is the pramāṇabhūta-puruṣa (person of (...) epistemic and moral authority), sarvākārajñatājñānaṃ (omniscient, wise), pratyakṣalakṣaṇam (exclusively perceptual in characteristic) [Candrakīrti (MABh VI.214)], and claims that there are clearly four pramāṇas—epistemic warrants—direct perception (pratyakṣa), inference (anumāna), testimony (āgama) and analogy (upamāna) [Candrakīrti (Pp I.3), cf. MacDonald 2015, pp. 287–288]. On the other hand, somewhat paradoxically, Candrakīrti claims that buddhahood is an embodiment of a complete cessation of “mind and mental processes” [Candrakīrti (MABh XI.1, 155a; MAB XI.17d)] Now how are we to make sense of these two seemingly contradictory statements? Do these statements reflect any deeper conflicts within Candrakīrti’s system or is there a coherent way to interpret these statements? The Tibetan Prāsaṅgika interpreters of Candrakīrti’s Madhyamaka largely agree that there is no internal contradiction in Candrakīrti’s system, and agree there is a way to make coherent sense of these statements. Nevertheless, the Tibetans exegetes bring to the table two radically conflicting proposals to approach Candrakīrti’s Mādhyamaka; both claiming to successfully address the apparent tension arising from Candrakīrti’s statements. One proposal is made by Tsongkhapa Losang Dakpa (Tsong kha pa bLo bzang grags pa, 1357–1419), who maintains the tension can be plausibly resolved by demonstrating that Candrakīrti’s unique non-foundationalist epistemological program renders him an epistemological coherentist. In contrast Taktsang Lotsawa Sherap Rinchen (sTag tshang Lo tsā ba Shes rab rin chen, 1405–1477) argues that according to Candrakīrti buddha is a global agnostic, on the ground of the nonexistence of mind and mental processes for those who have attained fully awakening. Taktsang instead proposes the no-mind thesis as a more plausible way to resolve the tension in Candrakīrti’s philosophy, categorically refusing to attribute to buddha any cognitive processes and epistemic warrants. This paper is an analysis of Taktsang’s no-mind thesis—the claim that buddhas utterly lack any knowledge of the world because they do not have epistemic processes and warrants to perceive the world—in what follows a rational reconstruction of his arguments is developed in order to evaluate his thesis. We shall then assess the implications of accepting Taktsang’s no-mind thesis. (shrink)

In this paper, I argue that many arguments from expert opinion are strong arguments. Therefore, in many cases it is rational to rely on experts since in many cases the fact that an expert says that p makes it highly likely that p is true. I will defend this claim by providing 5 arguments that illuminate and elaborate on 5 crucial claims about expertise. In this way, I aim to undermine recent attempts to establish a rampant scepticism about arguments from (...) expert opinion. (shrink)

Intellectual humility is an interesting but underexplored disposition. The claim “I am (intellectually) humble” seems paradoxical in that someone who has the disposition in question would not typically volunteer it. There is an explanatory gap between the meaning of the sentence and the meaning the speaker expresses by uttering it. We therefore suggest analyzing intellectual humility semantically, using a psycholexical approach that focuses on both synonyms and antonyms of ‘intellectual humility’. We present a thesaurus-based method to map the semantic space (...) of intellectual humility as a heuristic to support philosophical and psychological analysis of this disposition. We find three semantic clusters that compose intellectual humility: the sensible self, the discreet self, and the inquisitive self; likewise, we find three clusters that compose its contraries: the overrated self, the underrated other, and the underrated self. Curiosity is a wonder of the human mind. It goes to the heart of modernity, as a driving force for learning, novel insights, and innovation, both for individuals and communities. In societies dependent on science and development, finding out what promotes or hampers curiosity and wonder in school curricula and science education is accordingly essential. In this conceptual article, I suggest a framework for curiosity-based science education and I explore options for its wellbeing and development during preschool, preadolescence, and adolescence. In preschool, curiosity and wonder are triggered by perceptive beauty rather than by facts, and a method emphasizing maximism as a complementary factor in preschool science education is proposed. In prepuberty, curiosity is encouraged by exploring the diversity of the world. Facts and clear-cut knowledge constitute a firm foundation for scientific thinking. In high school, curiosity is ignited by means of a better balance between models and phenomenology. Criticism has arisen over the one-sided use of models in high school science education, which limits scientific thinking to frameworks defined by the actual model. Possible solutions to maintain students’ curiosity and ideas to improve the balance between phenomenology and models are discussed. (shrink)

In this paper, I want to ascertain whether there is an interest-based moral position to claim in Confucian ethics. This is crucial to a further ascertainment of moral human rights in Confucianism, because a moral position to claim is a necessary condition to a moral right. Upon careful textual analysis of some of the passages in Mencius, I argued that such moral position to claim is implicit but actually available in Confucian ethics. In a review of the Punishment of the (...) Outcast in Mencius 1B:8, I argued that Mencius not only agrees that people should revolt against the despots, but also that their doing so signifies what Joel Feinberg calls “the activity of claiming.” In other words, it is Mencius’ point of view that when things come to a person’s vital interests, namely one’s own life in this case, it is morally justified for one to act thus claim on one’s interests. I conclude that while an interest-based moral position to claim is found present in Confucian ethics, this does not necessarily mean that a Confucian moral rights discourse is ready. While such position to claim is no doubt crucial to a ‘rights-engineering’ in Confucianethics, attempts to ascertain other elements of a moral right, namely a claim-against and a moral duty are required. The aim of this article is to strengthen links between cognitive brain research and formal logic. The work covers three fundamental sorts of logical inferences: reasoning in the propositional calculus, i.e. inferences with the conditional “if...then”, reasoning in the predicate calculus, i.e. inferences based on quantifiers such as “all”, “some”, “none”, and reasoning with n-place relations. Studies with brain-damaged patients and neuroimaging experiments indicate that such logical inferences are implemented in overlapping but different bilateral cortical networks, including parts of the (...) fronto-temporal cortex, the posterior parietal cortex, and the visual cortices. I argue that these findings show that we do not use a single deterministic strategy for solving logical reasoning problems. This account resolves many disputes about how humans reason logically and why we sometimes deviate from the norms of formal logic. (shrink)

Social enterprises, like almost all organizations, continuously strive for external legitimacy. To be perceived as externally legitimated by society, social enterprises often engage in strategic partnerships. However, scholars have only recently turned their attention to the legitimating function of such partnerships. The purpose of this article is to address the hitherto neglected construct of inter-partner legitimacy. Drawing on institutional theory, we hypothesize that such inter-partner legitimacy affects the resource transfer among partners, which will, in turn, be recognized by society and (...) will subsequently affect each partner’s external legitimacy. Dyadic data of 121 strategic partnerships between social enterprises and their key partners confirm our hypotheses. We add to institutional theory by integrating the often ignored dimension of inter-partner legitimacy into our analysis and demonstrate its relevance to each partner’s external legitimacy and to resource transfer. Further contributions to the literature on institutional theory, legitimacy, social entrepreneurship, and inter-organizational relationships are identified. (shrink)

This text addresses various topics in applied ethics from Western and non-Western perspectives. Multicultural perspectives are fully integrated throughout the text.

We investigate peer influence on managerial honesty under varying levels of transparency. In a laboratory experiment, managers report their costs to a superior to request budget. We manipulate whether the managers learn each other’s report and cost or the report but not the cost. The results show, first, that managers are susceptible to peer influence, as they join peers in reporting honestly and dishonestly both under full and partial transparency. Second, however, the effect of peer influence is asymmetric. While managers’ (...) dishonesty increases much when peers’ reports are higher than they have expected, the opposite is not true. Third, partial transparency reinforces this asymmetry in peer influence. Unlike full transparency, it allows managers to substitute self-serving assumptions for missing information and to thus justify their own dishonesty more easily. The contribution of this study is twofold: It provides evidence for the interaction between transparency and peer influence and it highlights the role of expectations in fueling dishonesty. Our findings warn firms that especially partial transparency may spread dishonesty more than honesty. Transparency may also hurt firms that push honesty norms but fail to enforce compliance, thus raising and disappointing managers’ expectations. (shrink)

In 2009 Larry Alexander and Kimberly Ferzan published Crime and Culpability: A Theory of Criminal Law. The book set out a theory that those who deserve punishment should receive punishment commensurate with, but no greater than, that which they deserve. Reflections on Crime and Culpability: Problems and Puzzles expands on their innovative ideas on the application of punishment in criminal law. Theorists working in criminal law theory presuppose or ignore puzzles that lurk beneath the surface. Now those who wish (...) to examine these topics will have one monograph that combines the disparate puzzles in criminal law through a unified approach to culpability. Along with some suggestions as to how they might resolve the puzzles, Alexander and Ferzan lay out the arguments and analysis so future scholars can engage with questions about our understanding of culpability that very few have addressed. To many readers, it has seemed that Kant's discussion of the relation between practical and transcendental freedom in the Transcendental Dialectic is inconsistent with his discussion of the same relation in the Canon of Pure Reason. In this paper I argue for a novel way of preserving the consistency of Kant's view: in both the Dialectic and the Canon, 'transcendental freedom' requires the absence of determination by all natural causes, whereas 'practical freedom' requires the absence of determination by, specifically, sensuous (...) incentives. However, I argue that the defense of freedom presented in the Canon is abandoned by Kant in the Groundwork when he first develops his conception of the absolute purity of moral motivation. (shrink)

The two main domains of high culture - the arts and the sciences - seem to be completely different, simply unrelated. Is there any sense then in talking about culture in the singular as a unity? A positive answer to this question presupposes that there is a single conceptual scheme, in terms of which it is possible to articulate both the underlying similarities and the basic differences between these domains. This article argues that - at least in respect of ‘classical’ (...) modernity - there is such a framework: the normatively conceived Author-Work-Recipient relation. It allows the disclosure of the paradoxical unity of culture: its two main realms are constituted as polar opposites and thus as strictly complementary. Through such an organization, culture could fulfil an affirmative, compensatory role. At the same time however, it also allowed culture to acquire the character of social critique, a function realized through the antagonistically opposed projects of Enlightenment and Romanticism - projects whose illusions are now evident. During the influx of neurological research into France from across Europe that took place rapidly in the late 19th century, the philosophy course in lycées (the French equivalent of high schools) was mobilized by education reformers as a means of promulgating the emergent brain sciences and simultaneously steering their cultural resonance. I contend that these linked prongs of philosophy’s public mission under the Third Republic reconciled contradictory pressures to advance the nation’s scientific prowess following its defeat in the Franco-Prussian war (...) of 1870 without dropping France’s distinct tradition of 19th-century spiritualism, which extended from Maine de Biran’s philosophical psychology to Victor Cousin’s official eclectic spiritualism. Between 1874 and 1902, the French Ministry of Public Instruction transformed philosophy into a national project designed to guide the reception of experimental psychology generally and neurology in particular. This article features original archival research on philosophy textbooks and students’ course notes that illuminate the cultural and intellectual impact of these sciences in the fin de siècle from inside the classroom. I argue that the scientific turn in the psychology section of the lycée philosophy course reflected and brought about a distinct philosophical movement that I call ‘scientific spiritualism’. While historians have analysed philosophy instruction as a mechanism used by the Third Republic to secularize students, this article sheds new light on lycée philosophy professors’ campaign to promote scientific spiritualism as a means to advance incipient brain research and pare its reductionist implications. Angesichts des vielfach diagnostizierten Ausmaßes der Zerstörung des Planeten Erde wird aktuell viel über die Notwendigkeit der Neuzusammensetzung des lebendigen Sozialen nachgedacht. Als Alternative zur klassischen Anrufung der Gesellschaft und den von ihr einzuleitenden Maßnahmen gegen den drohenden Untergang wird auf neu zu erschaffende Kollektive gesetzt, die sowohl menschliche als auch nichtmenschliche Akteure umfassen. Diese neuen Kollektive sollen sich durch Bündnisse, Symbiosen, Kooperationen, Assoziationen und Verträge konstituieren. Vergleichbar werden die im Detail verschiedenen, insgesamt aber posthumanistisch ausgerichteten Vorschläge, durch ihren gemeinsamen (...) Ausgangspunkt der verletzten Erde, für die Rettungsmaßnahmen in Gang gesetzt werden sollen: Bündnisse, die Gaia stiftet - im Angesicht der drohenden Gefahr! Im Mittelpunkt der Überlegungen von Lynn Margulis, Michel Serres, Bruno Latour und Donna Haraway, die im Folgenden diskutiert werden sollen, steht die Suche nach der Verbindung und Kooperation mit anderen als nur menschlichen Lebewesen. Die gesuchten Verbindungen, Verflechtungen und Versammlungen von menschlichen und nichtmenschlichen Akteuren werden jedoch, so meine These, überwiegend im Sinne eines friedlichen Miteinanders ausbuchstabiert, während andere Formen der Verbindung dagegen, etwa durch stabile Gegnerschaft, andauernden Streit, stetige Auseinandersetzungen, vernachlässigt werden. Die während der Zusammensetzung der Kollektive notwendig werdenden Grenzziehungen und mit hoher Wahrscheinlichkeit auftretenden Konflikte um die Frage der Zugehörigkeiten werden weitgehend ausgeblendet zugunsten eines immensen Vertrauens in die Bereitschaft zur Versammlung und die Friedfertigkeit der Kollektivbildung. In this highly original book, Markus Gabriel presents 'Neo-Existentialism', an anti-naturalist view that holds that human mindedness consists in an open-ended proliferation of mentalistic vocabularies. Challenged by Charles Taylor, Andrea Kern and Jocelyn Benoist, Gabriel deftly refutes naturalism's metaphysical claim to epistemic exclusiveness.
